Invoicing - Overview


OVERVIEW -- Invoicing and Collection

In addition to delivering responsive documents, you can use Safari to automate invoicing and payment collection.  This help page summarizes key features, links you to more in-depth help pages, and discusses when and how much your company might charge for subpoena response.

Key Features

A. Financial folder (where invoices store): The Financial folder contains the invoice that you'll present to the Issuer.  If you select a Safari-generated invoice type (see below), you can view the auto-generated invoice in the Financial folder.  If you're manually uploading an invoice, you should store it in this folder.  Documents in the Financial folder are presented to the Issuer as part of the paywall.  To see what the invoice presentment looks like to the Issuer, see SecureShare - Issuer Experience.
B. Financial section (left-side panel, where details such as prepayments store): You can enter financial information about the matter (e.g., a prepayment amount or invoice type) while the matter is open. 
C. Invoice Types (different ways to generate invoices). The picklist of invoice types (shown in the Financial section of matter details and in the Delivery Setup steps) displays the options for generating an invoice:
  1. Safari-Generated Invoice – If you select either a company-preconfigured invoice or a “Custom / Negotiated Amount” invoice, Safari will automatically generate the invoice for you. The amount of the invoice (less any prepayment) will automatically be collected from the issuer via the SecureShare paywall.
  2. Uploaded Invoice in Financial Folder – If you have manually created invoice, you can upload that to the Financial folder, enter the amount as part of the Delivery Setup, and the amount of the invoice (less any prepayment) will automatically be collected from the issuer via the SecureShare paywall.
  3. Manually Sent – If you want to send an invoice without using the SecureShare paywall, select this option. The paywall will be turned off and the issuer will be able to download responsive documents without entering a credit card number.

D. Credit Card Paywall (automated invoice payment). Selecting a pre-configured invoice, custom invoice, or uploaded invoice activates the paywall:  the portal requires payment via credit card as the Issuer downloads responsive documents.  If you don't want to use the paywall, select "No Invoice / No Cost Recovery" or "Manually Send Invoice."  To learn more about the paywall and tracking Issuer payments, see Invoicing - Paywall & Tracking Payments.

Is invoicing required? 

No.  To make documents available without turning on the paywall, in the Invoice Type picklist, select "No Inv / No cost recovery."

When is invoicing appropriate? 

DISCLAIMER:  Safari does not provide legal advice. Each company must make its own determination as to when and what amount of cost recovery is appropriate.  

In some cases, the law is clear that the party issuing a subpoena must reimburse a third party for its costs in responding.  In other instances--and particularly for routine subpoenas--many companies adopt a practical approach to collecting response costs.  They commit to comply with the subpoena and also ask that the issuer reimburse their reasonable cost incurred.  Nearly all issuers consider this request reasonable and pay the fees requested.  In the rare case that an issuer declines to pay, the company simply complies with the subpoena without being reimbursed. 

How much should we charge to respond to a subpoena?  For routine "go and get" subpoena responses, companies that choose to recoup their response costs generally base a fee schedule on the cost of employee time spent responding.  Safari can supply you with resources on billing policies and fees charged by other companies.
